Repeal of the ACA's Individual Mandate…But Wait

The Senate passed its tax bill, which included a repeal of the ACA’s individual mandate. Individuals would no longer be required to pay an annual tax penalty equal to 2.5 percent of their household income or $695, whichever is greater. The measure still has to be reconciled with an earlier House-passed version before being sent to President Trump.

If an employee asks about the penalty, we recommend you decline to answer yes or no until the final tax bill is signed at the end of the month.

This has been a contentious topic on both sides of the aisle so expect further changes and new bills to be introduced and voted on by the end of the year.

We will provide talking points for employers once the decision is final.
