Preliminary Injunction Against New Fair Labor Standards Act Overtime Rule

The Federal overtime ruling is on hold... .for now!

A federal judge in Texas just gave employers a gift to be thankful for on November 22, 2016. The Department of Labor’s (DOL’s) new federal overtime rule, which would have doubled the Fair Labor Standards Act’s (FLSA) salary threshold for exemption from overtime pay has been placed on hold. The overtime rule will not take effect as scheduled on December 1, but may be implemented at some point in the near future.

Employers can continue to move forward with implementing exemption status changes as planned or hold off until a final ruling is made. Employers shouldn’t presume that the overtime rule will be permanently barred. They should still have a plan to move forward if necessary in the future.
